Study agreement concerning digital material

Please read carefully the following instructions and conditions concerning the use of digital material in learning.

This agreement, which covers student access rights to the learning material supplied by Haaga-Helia (the organiser of the teaching) and the rights of Haaga-Helia to the material produced by the student, is a legally binding agreement between the student and Haaga-Helia.

This agreement is valid between Haaga-Helia and the student, unless otherwise agreed on digital material. Upon accepting the terms of this agreement and registering as a student in a Haaga-Helia degree programme, the student agrees to adhere to the instructions and conditions of this agreement.

1 Student rights to learning material

1.1 Access right restrictions

The organiser of the teaching will provide the student with the right to access the learning material relating to teaching free of charge and within the scope required for the learning.

The student is granted the following rights of access in connection with his or her studies:

  • the right to save material in digital format in computer memory, diskettes or some other digital platform
  • the right to print learning material within specified printing rights
  • the right to make back-up copies of the learning material
  • the right to make changes to the material and append the material to other study material within the scope of the relevant copyright legislation
  • the right to make use of altered material in the same way as original material
  • the right to display and present material, and its alterations, in connection with online learning
  • the right to distribute printouts to other students participating in the learning within the scope of the relevant copyright legislation
  • the right distribute the material by other means participating students in order to complete designated assignments (e.g. group work).

The use of the learning material in any other context than learning is prohibited without prior written consent from relevant party involved. The public use, distribution, presentation of any copies made within the scope of this Agreement (or making such copies available to the public in any way) for any other purpose than learning is prohibited.

The rights of access granted with this Agreement cannot be transferred to a third party.

1.2 Moral rights

Whenever using the learning material, or any parts thereof, the student is to indicate its author and any other rights holders in accordance with good practice. Any references made to rights holders in the material cannot be removed.

1.3 Instructions pertaining to the use of software

In cases that the learning material contains software in object code, the following actions are prohibited without prior written approval by the holder of the rights to the software, except when the relevant legislation allows for this:

a) the conversion of the software into source code, or its transformation/conversion into a format interpretable by people

b) the alteration of the software, or the making of new versions or derivatives

c) the combination of the software with other software

d) the sublicensing, lease, making of a lease agreement, borrowing of the software, or its distribution in original or altered format through any means, and

e) the copy or use of the software for any purpose other than the purposes specified in section one of this Agreement.

2 The duty of the student exercise care with respect to user rights

The student is under the obligation to adhere to the limitations with respect to user rights specified in this Agreement. The student must exercise care in safekeeping his or her user ID and/or password, and take care that this user ID and/or password will not be made available to a third party. The student is responsible for any material that has been accessed with his or her user ID and/or password.

3 Liability for damages

The student is responsible for any damages that may incur to Haaga-Helia as a result of the use of the learning material by the student in breach of this Agreement.

4 Consent to the use of material produced by the student

The student agrees that the organiser of the learning has the right to use the material produced by the student in connection with the learning in which the student participates. The organiser of the learning has the right to make copies of the aforementioned material in any format whatsoever, as well as to show and present copies of this material to other course participants, and also to make this material available to other course participants.

5 Applicable legislation and settling of disputes

This Agreement shall be governed by Finnish law, and disputes pertaining to the Agreement shall be settled in the Helsinki District Court.

Approval

With my signature in the relevant section of the Haaga-Helia Student Personal Information Form, I approve the conditions set forth in this Agreement.
